This is with respect to the sad event of May 19, 2008 that occurred at the Imam bargh Qasar-e-Hussain and its Matwalli(the custodian) and his family while he was busy in arrangement of Majlis of Imam Hussain(A.S) at around 3 p.m. in the afternoon a group of hooligans numbering around 30 loaded with guns accompanied by the court baliff and the local police. They asked the Matwalli to vacate the one kanal and two marla of the Imam Bargh. The Matwalli asked the court baliff to give him two days to answer the court since in the court order the Matwalli was declared as tenant and the owner was shown as Syed Hassan Askari Bokhari-the real brother of the Matwalli. Somehow, surprisingly the same brother had already given bequest in the favour of the Imam Bargh Qasar-e-Hussain and a waqaf nama dated back to 1972 and also the case of which is already under the court underlined as Imam Bargh Qasar-e-Hussain Vs Sons of Hassan Askari Bokhari since 2004. Moreover, the matter is still subjudice and needs restriction at the part of the Matwalli not to come in the court of contempt purview.
The action was so quick and nerve breaking, the Matwalli owing to the old age could not understand the whole situation that how at the same time a property case which is pending before the court can be an ejectment property. Also the younger son of the Matwalli was taken to the police station with no prior knowledge of the Matwalli without showing any arrest warrants by the then SHO Mr.Saeed, who had technically kidnapped the Matwalli son for three hours till the completion of the barbaric operation.
Somehow, all the hooligans headed by an area wicked namely Billo Badmash entered the premises of the said Imam Bargh and encroached the sanctity of the Imam Bargh with the gun totters who looted, plundered and rampaged through every thing without having any mercy and respect for humanity. With hell of worries and troubles, the ladies and the grand children of the Matwalli were also harrassed and manhandled, and still are suffering from psychological trauma which has already been explained in the Imam Bargh website namely www.qasarehussain.com. The Matwalli and his family passed the May 19th ,2008 night by sitting in the Imam Bargh Hall only weeping and crying hoarsely and call upon their Allah and the Holy Prophet(Peace be Upon Him) and his beloved son Hazrat Imam Hussain(A.S) to come down and take revenge from those hooligans and their perpetrators and abettors, who have done this undesirable act of hoolignism, inhumanism and barbarism in 2008 in the presence of highly sophisticated society claiming eloquently its respect for its fundamental human rights.
Anyways, Mr.Billo and his associates kept on drinking and abusing through out the night and asking the Matwalli to leave the area as soon possible but the Matwalli and his family were so determined in their believes that they would not leave the place even their lives were taken to death. Somehow, on the next morning the Billo Badmash brought more army of his men and started the demolition from the north-side of the Imam Bargh .Because, on the south-side, the Matwalli and his family had taken refuge. The women were weeping and crying and the kids were crying and asking that why the building was demolished and, the billo Badmash on whom order he was doing. The Matwalli did not know ? The Billo Badmash kept on demolishing the premises till the arrival of the first court stay order from the same court which passed the forged decree right at 6 p.m. in the evening. The same order was given to the then SHO Mr. Saeed. He apologized to the councel,Malik Sarood Ahmed-the Secretary Lahore Bar- of the Matwalli that he could not do any thing in that regard because it was out of his jurisdiction to stop the demolition. Also Police Station Muharar( registrar) refused to receive the copy of the order by not giving the registry number on the copy of the order that particular day.
Somehow, the copy of the same court order was pasted on the main gate and operation of demolition was stopped by the Matwalli and his councel’s another member, Syed Imdad Hussain Bokhari-advocate High Court Lahore. The neighbour and the area people are witness of this procedure and happening. The timely halted demolition operation was again started on May 21st, 2008 morning by the same Billo Badmash by bringing cranes to demolish the remaining premises of the Imam Bargh-the 15 police calls if recorded could be the best proof for you to investigate the matter. The same SHO came on the spot and said to Matwalli that he could not stop since he had no special judicial instruction to stop the demolition.
Again, the Matwalli and his councel-Malik Sarood Ahmed & Associates managed to bring the second court order that specifically ordered the SHO of the area to stop the demolition immediately of the premises. The fascist operation was halted at around 3 p.m after hell of calls to 15 and SP Cantt.office, if the records are available, are the best and undeniable proof of the violation of the law of the land. The same SHO came with broken heart and stopped the demolition. This time the then Muharar(the registrar) did the same by not accepting the second order to be registered in the police station. Somehow, the ugly operation was halted and the matter is sub-judice in two courts simultaneously.
Before completing the inhuman, irreligious and immoral operation, the hooligans looted and plundered all the valuables including cash, jewelry, bonds and other articles of millions of rupees were broken and stolen from the Imam Bargh premises. After the successful theft and plundering the court baliff handed over the possession of the Imam Bargh to the Billo Badmash who locked the main gate from inside and practically got the control of the whole Imam Bargh by deploying his armed men around and above the roofs of the Imam Bargh. They also got vacated the Imam Bargh’s rented shops and destroying and throwing their material out the shops including the Utility Store Corporation of Pakistan, which was especially opened by the Matwalli to cater the needs of the poors and needy with the kind efforts of the last premier, Mr.Saukat Aziz.
Also, the Matwalli and his family was practically kept hostage for three days from 19th May to 21th may till 3 p.m in the afternoon. During the hostage the Imam Bargh light, gas, water and telephone connections were disconnected only compelling the Matwalli and his family to leave the Imam Bargh. The Matwalli was taken aback why that was happening since he had no communication links with outside world and even he had no contacts with his brother-Syed Hassan Askari Bokhari – who is still missing and not appearing before the honourable court of the Civil Judge/Rent Controller Mr.Moeen Khokhar The councel of the Matwalli, Mr. Malik Sarood Ahmed-the advocate high court and the secretary Lahore Bar- has also asked the Matwalli to present the defendant-Mr Syed Hassan Askari before the court for its early decision, since the judge is very honest and wish to finish the case as soon as possible because it is a religious matter that can flare up in the country very fastly particularly in Pakistan and all over the world as a whole. Allah bless upon our beloved country, Pakistan.It is quite stunning that on the last court hearing i.e. June 28,2008, the wicked, Mr.Billo with his accomplices attended the court proceeding and taunted the Matwalli that they will do whatever they like. God curse on those who support that kind of people and the Satan mardood is their collaborator. But, according to the area people Mr.Syed Hassan Askari came on the tragic place and claimed that he was not behind the demolition of the Imam Bargh. Then the million dolor question is who has committed this haram act ?
The Matwalli had already sought the help of the city police by giving an application to the Capital Police Officer and given a copy to the concerned police station-Baghbanpura, Lahore. I, being the Matwalli and all the believers of Hazart Imam Hussain(A.S) of not only Pakistan but of the world request you and the higher ups to investigate the whole matter very honestly and impartially and assist us in searching out my real brother Syed Hassan Askari Bokhari ; perhaps, we fear and doubt that he disappeared only due to the pressure of the Billo Badmash or his associates, and present the defendant- Syed Hassan Askari – before the court to clarify his position. This will not only keep the law and police on high stature but also my community passions will come down and the peace will prevail in our beloved country, Pakistan, which is already burning in the fire of judicial, social, economical and political crisis. I shall be greatly thankful for your nice cooperation keeping in view the gravity of the matter.
