Background of the Event

The Matwalli father, the late Syed Khadam Hussain Bokhari-a true believer of Allah, in late 60’s decided to build an Imam Bargh-a place for the Zikir(the preachings&teachings) of the great and beloved son of the Holy Prophet(Peace Be Upon Him), Hazrat Imam Hussain(A.S), with a gifted amount he got of a scheme of the homes allotted by the newly built state, Pakistan; out of the sub-continent, through his special pledge to Hazrat Imam Hussain(A.S) that he-Syed Khadum Hussain Bokhari- would make a place of the Imam(A.S) to preach and teach Imam’s great human sacrifices for this planet earth, who was desirous of complete peace and tranquality for the humans of this world and the hereafter(Akharat). Somehow, after getting his lottery, the gifted home, he planned to search out a suitable place in Lahore- Punjab- Pakistan, and met with a renowned Azadar(the staunch preacher of Imam Hussain A.S) namely late Syed Ali Hussain Naqvi-a renowned personality of Lahore, advised Syed Khadum Hussain to construct the Imam Bargh in the Tohkar Niaz Beig,a rich area of Momineens.Thus Syed Khadum agreed and and visited the poposed area for his final go-head. In the mean time the second son of the late Syed Khadum Hussain namely Syed Hassan Askari and Mrs.Hassan Askari namely Mrs.Rafiq Bokhari-a retired principal-approached the late Khadum Hussain Bokhari to construct the same Imam Bargh-Qasar-e-Hussain. 

Event on day to day basis:

Sadly, on 19th May 2008, the same Imam Bargah was attacked by some anti Ahle-e-Bait elements/ hooligans, and they demolished and desecrated its adjoining areas/ buildings containing Langar Khanas, sitting areas, washrooms, Tazia places, Matwalli residence, ladies Matam areas etc. The remaining areas were saved through the local court action.  The hooligans looted and plundered all the valuable and sacred articles from the places. Curse on them who have done this unbelievable Haram-fobidden- act, and we all pray for their early Hell entry. We also all pray for the reconstruction of the Imam Bargah. All Momineens of the world are requested to demonish this Haram Act and also pray for Imam Bargah Qasar-e-Hussain’s early restoration and its grandiosity.
The Matwalli(the custodian) of the Imam Bargah Qasare-e-Hussain since 19th may 2008, after the demolition of the same Imam Bargah, has no living space not even the lavatory, because all has been demolished by the hooligans and miscreants with the assistance and collaboration of judiciary and police. The case is still in the court and moving like a snail’s  pace without having a single witness so far called upon and ironically no man from the side of the opposite party(the decree holder) including the real brother- Syed Hassan Askari Bokhari, of the Matwalli- Syed Baqir Ali Bokhari has so far appeared before the court since Syed Hassan Askari Bokhari had shown his brother Syed Baqir Ali Bokhari- Matwalli Imam Bargah Qasar-e-Hussain as his tenant by mutilating the facts through forgery and fraudulent practices with the help of judiciary and police.
Unfortunately the decree holder, Syed Hassan Askari Bokhari claiming 1 Kanal & 2 Marlas of land as his personal property which he had already given to the Imam Bargah Qasar-e-Hussain as Nazrana-dolled out, stamp paper of which is preserved with the Matwalli having the thumb impression and signature of the satan-minded person mentioned above (the same can be seen by clicking Waqaf Nama-Bequest). Till to date, 24.06.08 the same judge namely Mumtaz Khokhar-Civil Judge/Rent Controller, Lahore has asked our lawyer Mr. Sarood Ahmed- Advocate High Court/Secretary Lahore Bar to submit an application before a Session Court Judge to advise him to finish the case as soon as possible, instead of beseeching before the session court the Matwalli prayed before the honorable court that it may please decide in his favour or not since the issue is very sensitive and the Momineens of the area passions are controlled by the Matwalli very difficultly. However, what the judge has suggested regarding pray to session court is again a matter of legality that is open to the legal minds to see what is right or wrong.
On the other hand the Matwalli is living on the bricks without having any lavatory with such inhuman odd conditions besides arousing the religious emotions of the area People who are asking who is behind this demolition is a big question of shamefulness for the humanity as a whole. Since this is a religious place and the same Imam Bargah is registered with the Pakistan Azadari Council ( a forum for the registration of the Imam Barghs), which may flair up the passions of the whole country’s Momineens, can have severe aftereffects upon the fragile and poverty-stricken economy of our beloved country. Having described the above conditions is also an utter violation of the fundamental human rights declaration, then why the Human Rights Organizations are sleeping till to date?
Come on, the Satan-mardood, who is trying his best to defeat Rehman- Almighty Allah & All Prayful, which is not possible because the Satan is Batil- Flasehood.  Please check the situation on the ground because the case is there, and the Matwalli is there, and the demolished Imam-Bargh is there.
On 28th May the hearing of the case was conducted in such a strangeful and shameful way that the exparte decree holder Syed Hassan Askari Bokhari was not present but the same lot of the hooligans and miscreants who played havoc with the Matwalli and Mominees lives and demolished the said Imam Bargah under the cruel guidance of the Billo Badmash (wicked) roaming in the court and presenting himself as the legal owner of the property having asked by the Matwalli Imam Bargah- Syed Baqir Ali Bokhari what he was supposed to be doing there, he again threatened the Matwalli that he better should refrain from the court proceedings. This was such an undesirable and unlawful act at the part of our Government functionaries that a person who had led to such a crime which is unpardonable in the human history, is once again in front of the Matwalli Imam Bargah Qasare Hussain. Undoubtedly, this has really disturbed the mental faculties and abilities of the Matwalli and the Momineens of Pakistan and abroad that what kind of judiciary and police functionaries are functioning in such a beautiful country like Pakistan which is already fighting a strange war of independence of judiciary with the help of lawyers and the civil society. Anyways, Allah, the All Powerful is watching the whole situation and it is not possible that Satan/ Devil or Rakshas or whatsoever the evil forces shall be the winner in this war of Truthfulness (Haq) and Falsehood (Batil). It shows the character of the Billo Badmash (the wicked/ hooligan) is being personified in the form of Rakshas/ Devil/ Satan etc. and the character of the Matwalli (the custodian) is being personified in the form of Allah/ God/ Bhagwan etc.
Somehow, the miscreants and the all powerful Billo Badmash (the wicked) so strangefuly and surprisingly asking the same honorable Civil Judge to appoint a commission which will decide whether this is a religious property or a simple livable property. The respectable judge has given a new date of July 5th, 2008 to give his decision regarding the appointment of the commission. Therefore, we all are: the international fundamental rights organizations, the world over Governments, the NGOs and all other possible human organizations around the Earth Planet, watching and observing the whole situation very seriously and anxiously that what would be the decision of the concerned judge on the mentioned date. So if the honorable judge goes in the favour of the wicked Mr. Billo Badmash then what happens, it is upto you to decide what you have to do and, otherwise; if the decision goes in the favour of the Matwali then what happens. Obviously, it is all clear that Falsehood has to die and Truthfulness has to live forever at the end of the war.
Irrespective of the above facts the Matwali has decided to expose all those things which are so far out of the eyes of the humanity all over the world including the actual position and situation on the ground and all those who have been involved in this matter since the construction of this great worshipping place. Now this is no more a sect-religious matter but has become an international issue rather the Earth Planet issue where the Satan/ Devil or Rakshas is presenting himself so highly by trampling all the human values like a Giant Eelephant walking arrogantly on the land of the All-mighty Allah/ God/ Bhagwan/ Bhudda etc. having no respect and honor for anything, even less than an ant creeping on the ground having no muscular powers is being trampled by that proudly walking elephant, so this is so strange for all of us that the currently developed sophisticated  armaments and nuclear weapons have completely been defeated by the satanic or devilish powers to save and protect the humanity and tranquility and peace on the earth planet, then again so sorry for this human being who is so fragile and subtle to fight against the evil forces, what would happen if he/ she has to fight against the Gigantic and Gracious power of Almighty Allah. Therefore, man has been entrapped by the intrigues of the Devil. Somehow, we all are sitting in the same boat having no destination to reach on the destined place because we all are lost at one way or another way. This is a story of a human being since its creation. So why this vicious circle of unending traumas of human sufferings happening on the ground is the destiny of this fateful human being having no food, clothes, living and respect, honor etc. on this Earth Planet. Well, sorry to all the high time developments so far, have utterly failed to provide a peaceful and tranquil environment to the fellow human beings. God bless those who are the champions of the human rights are still unable to provide the humanity the all promised and God given human rights. What is this, this is only the Devil or the Satan who is playing his role to rip-off human beings and they, humans, have become enemies of themselves by adopting devilish and satanic ways of living that is arrogance, no respect for poor, adulteration, dishonesty etc. and whatnot. No problem being a representative of Allah I feel all should think like me since we all are the human beings as we should think, care and help for each other but not for the Satan or Devil.
Now the Matwali of the said Imam Bargah has presented his new application under the subject of termination of forged experte decree pon 30th, June 2008 after a sorrowful 28th June, 2008 hearing day to the same Civil Court Judge Mr. Moeen Khokhar based on some facts which is asking for some logical questions based on facts and figures. The copy of that letter is affixed with this event narration. On the other hand a new and strange fact is that this 1 Kanal and 2 Marlas is already a subjudice matter for the last four years in another court of Civil Judge Mr. Shehzad Hussain, so this event which started from 19th May 2008 has all been explained in a new application under the subject of invoking of court of contempt is also affixed with this event narration.
The hearing on July 5, 2008 of  the case  namely Syed Baqir Ali Vs Syed Hassan Askari was not included on the hearing list posted outside the court hall and the honorable Judge had only called both the attorneys of the case but not the parties as per the judge ruling on the last date, June 30, 2008 of the  hearing of the case: and the hearing started at 2:30 p.m. after a long wait from 8 a.m. the reason of which the Matwalli and hid associates could not understand. Anyhow, the law of the land matters. It was brought into the knowledge of the Matwalli,Syed Baqir Ali, by the attorney Mr. Sarood Malik that honorable judge has extended the hearing date from July 5 to July 11, 2008 because of the defendant attorney’s oral request that the defendant is severely ill, and the defendant has been given last chance by the august court. So it is again very strange that after a long wait the law was again made a mockery by the defense-since the matter is very serious and might entangle the whole Pakistan into the unending fire and the world at large. Anyways, the spirit of the Matwalli is so that he would fight in the court till death for the Truthfulness (Haq), also he is on the right path of Allah, and he is also law abiding and respectable citizen of a great nation-Pakistan- which has been achieved after lot of sacrifices under the commendable efforts of the founder the late Quaid-i-Azam, God may rest his soul in peace. 
On July 5, 2008, the Matwalli and his associate have to wait from 8 a.m. to 3 p.m. with no results. The Matwalli counsel Mr.Malik Sarood presented before the learned court and came to know that the defendants had given an oral request for the postponement of the hearing for the defense is severely indisposed. That was accepted by the learned court and the court gave another last chance to the defense to appear before the court on July 11, 2008. Now let us see on the said date what happens.
On July 11,2008, the counsel of the Matwalli Mr. Malik Sarood gave his arguments before the august court of Mr. Moeen Khokhar and the honourable court fixed the new hearing date on July 18, 2008 after the insistence of the counsel of the Matwalli. It is quite distressing that the Matwalli is still unable to understand why his real brother had not so for appeared before the court since its beginning, and also  on July 11, 2008 he was not present in the court. The Matwalli doubts that the advocate Mr.Mian Muhammad Saleem representing the defendant is not represented by his real brother Syed Hassan Askari Bokhari but by the hooligans, because the said advocate told the Matwalli that the said land measuring one Kanal and two Marlas had already been sold to various clients. It shows there is no respect of law in the eyes of Qabsa Group who is not doing illegal and illicit business of the worldly properties but of the religious ones as well. So this menace of Qabsa Group has become so flourishing and powerful that they can occupy and demolish any property including the religious with the help of the government functionaries.
The area police has so far failed to recover and present the defendant Syed Hassan Askari Bokhari before the learned court. Being a Matwalli on the behalf of the Momineens again request the police higher-ups to present the defendant. It will not only fizzle out the uncertainty attached to the case but also help the honorable judge to decide the case on merits.
Also the Matwalli has asked his counsel to a file suit for possession of ejectment in the court of senior Civil Judge/Rent Controller Mr. Moeen Khokhar for the early possession of the 18 Marlas property which has been fakely and fraudulently demolished by the defendant. The possession of the said property will facilitate the Matwalli to start the early reconstruction of the demolished Imam Bargh and this will mitigate the boiling passions of the Momineens.
